Alimony & Modification

In Florida, eligibility for such modifications requires the petitioner to demonstrate an involuntary substantial change in circumstances, particularly regarding income or the ability to comply with the financial obligations established in the parties’ Marital Settlement Agreement.

A “substantial change” is most commonly associated with a significant alteration in either party’s income. However, other factors may also be relevant. For example, modifications in the parties’ time-sharing arrangements—as children grow older—may result in one parent having significantly more or fewer overnight stays, thereby justifying a reevaluation of financial responsibilities.

According to Florida Statutes § 61.30(1)(b):

“The guidelines may provide the basis for proving a substantial change in circumstances upon which a modification of an existing order may be granted. However, the difference between the existing monthly obligation and the amount provided for under the guidelines shall be at least 15 percent or $50, whichever amount is greater, before the court may find that the guidelines provide a substantial change in circumstances.”
